Trade specifics with Kyrgyzstan

Kyrgyzstan has been an EAEU member since 2015: trade is simplified, but reporting and currency control remain

EAEU: no customs, but controls remain

Kyrgyzstan has been in the EAEU since 12 August 2015, so goods move between the countries without customs declaration or duties. Reporting still applies: a statistical form to the FCS and, above the thresholds, registration of the contract with the bank.

CISG applies

Kyrgyzstan has been a party to the Vienna Convention since 1 June 2000, Russia since 1991. The CISG therefore applies to a sale-of-goods contract automatically unless the parties expressly exclude it (Art. 6); the builder’s contract does not exclude it. This sets Kyrgyzstan apart from Kazakhstan, which is not on the list of contracting states.

Settlement currency

The national currency is the som (KGS). In the builder’s contract the price and payment are stated in one currency. If settlements are in roubles, write it down expressly rather than leave it implied.

EAEU indirect taxes

When goods are imported from Kyrgyzstan, VAT is paid by the Russian buyer — not at customs, but to its own tax office, together with the import application and the indirect tax return. On export the zero rate applies and must be confirmed with documents. Deadlines run from the date the goods are recorded in the accounts, so the delivery date in the contract must be determinable.

Questions about trade contracts with Kyrgyzstan

Answers about drafting a contract with a Kyrgyz company

Yes. The absence of customs declaration inside the EAEU does not remove the contract: it remains the basis for payment at the bank, a document for the tax office for indirect taxes and proof of the deal for the statistical form.
Yes. Inside the EAEU there is no goods declaration, and its role is played by the statistical form for recording the movement of goods, filed with the FCS.
Yes. Kyrgyzstan acceded to the Vienna Convention in 1999, and it has been in force for the country since 1 June 2000; Russia has been a party since 1991. Unless the contract says otherwise, the Convention applies automatically. It can only be excluded by an express clause (Art. 6 of the Convention); the builder’s contract does not exclude it.
The parties choose the currency themselves — roubles, som or a third currency. In the builder’s contract the price and payment are stated in one currency.
The full name, legal form and registration details in the contract must match the extract from the state register of legal entities of the Kyrgyz Republic.
No. No account or company profile is required — fill in the form and provide an email address for the finished document. Payment is a one-time charge, no subscription.
No. The document is generated in bilingual format from the start — Russian and English text run in parallel columns in one file. There is no need to order a translation separately: both texts are originals, and the Russian text prevails if they diverge (clause 9.1).
Neither, strictly speaking — it is a generator: the document is assembled from the data you enter in the form (parties, goods or services, delivery and payment terms) rather than taken from a ready-made template. Filling in the form and the preview are free, so you can see the result before paying.

Russia Trade Contract with Kyrgyzstan: EAEU Specifics

Kyrgyzstan has been a member of the Eurasian Economic Union since 12 August 2015, and trade with it follows the rules of the Union’s internal market: no customs declaration and no import duties. The document that formalises the deal does not disappear — it is the supply contract from Kyrgyzstan to Russia or the import contract from Kyrgyzstan.

What replaces the customs declaration

Inside the EAEU there is no goods declaration; the state collects data on the movement of goods through the statistical form filed by the Russian party with the FCS. Currency control works separately: when the obligations reach 3 million roubles for import or 10 million for export, the contract is registered with the authorised bank.

Indirect taxes instead of customs VAT

VAT on imports from Kyrgyzstan is paid not at the border but to the buyer’s tax office — together with the import application and the indirect tax return. Exports to Kyrgyzstan are zero-rated, and the rate must be confirmed. Deadlines run from the date the goods are recorded in the accounts on import and from the shipment date on export (paras 5 and 19 of the Protocol).

Governing law and the language of the document

Kyrgyzstan has been a party to the Vienna Convention (CISG) since 1 June 2000 and Russia since 1 September 1991, so the Convention applies to a sale-of-goods contract by default. The builder’s contract does not exclude it. The document comes in two columns, Russian and English: the Russian column is needed by the bank and the tax office, the English one stays in the file for the partner.

What to check in the details

The name of the Kyrgyz company and its legal form in the contract must match the state register of legal entities letter for letter. Bank details are given in full, including the SWIFT code of the counterparty’s bank.
