Questions about trade contracts with Belarus

Answers to questions about drafting a contract with a Belarusian company

Yes. Even within the EAEU, a contract is mandatory for currency control under 173-FZ. The bank checks payment terms, deadlines, and details for every cross-border payment. For amounts exceeding 3 million RUB, the contract is registered with the bank (assigned a unique registration number).
Yes. Within the EAEU, no customs declaration is filed, but for deals from 1 million RUB per month, you must submit a statistical registration form to the FCS. The deadline is 10 business days after the reporting month. Submission is via the foreign trade participant's personal account on the FCS website.
Belarusian companies are registered in the Unified State Register (EGR) — portal.egr.gov.by. Using the UNP (payer registration number), you can verify the company's name, status, and registration date. Include the counterparty's UNP in the contract.
The most convenient option is Russian rubles (RUB) — settlements go through without conversion via standard settlement accounts. The Belarusian ruble (BYN) is also used. Check the settlement terms with your bank and specify the agreed currency in the contract.
Belarus has acceded to the CISG. This means that, absent other provisions in the contract, the Vienna Convention automatically applies to contracts for the sale of goods. If you want to exclude the application of the CISG, state this explicitly in the "Governing Law" section.
